Experienced Waukesha Theft, Burglary and Property Crime Defense Attorneys

If you’ve been charged with theft of any kind in Wisconsin, retaining a knowledgeable criminal defense attorney will give your case its best chance for success.

According to Wisconsin statute 943.20, theft punishable by law includes:

  • Intentionally taking the property of another without the owner’s consent, with the intent of permanently depriving the owner
  • Converting to a person’s own use the property of another as a result of the person’s office or position, without the owner’s consent
  • Taking property from another who has a right to possession of the property, intentionally and without consent
  • Obtaining title to another’s property by intentionally deceiving the person with a false representation, made with intent to defraud
  • Intentionally failing to return any personal property in the person’s possession due to a lease or rental agreement.

But there are also different classes of theft with different severities, as follows:

  • Class A Misdemeanor Theft – Property or services stolen is less than $2,500.
  • Class I Felony Theft – Property or services stolen is greater than $2,500 but less than $5,000.
  • Class H Felony Theft – Property or services stolen is greater than $5,000 but less than $10,000 or is a firearm or is a domestic animal of value.
  • Class G Felony Theft – Property or services stolen is greater than $10,000.
  • Civil Penalties for shoplifters, or the parent or guardian of a juvenile shoplifter, when the total property stolen is of minimal value.

As you can see, there are many variables when it comes to theft charges, a lot of which depends on motive and value of the asset allegedly stolen. The consequences, if convicted, could affect you for the rest of your life.
